Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the first respondent to issue the transfer order from Krishnagiri District to Vellore District as per the petitioner's representation dated 18.03.2015. For Petitioner :

ORDER

By consent, the main writ petition itself is taken up for final disposal.

2. The case of the petitioner is that she is a Noon-Meal Assistant. She is working in the Panchayat Union Elementary School,

V.O.C. Nagar, Sanasandhiram, Hosur, Krishnagiri District. She rendered 9 years of service. The husband of the petitioner is a handicapped person and he is also suffering from other illness. The doctor advised that her husband could not stay in cold climate. The husband of the petitioner is now at Vellore District and her children are also studying in Vellore District.

3. The petitioner sought transfer to Vellore District. The respondents 2 and 3 made appropriate recommendations for her transfer to Vellore District and those recommendations were sent to the first respondent. But the first respondent has not passed any order.

4. It is the further case of the petitioner that one other Noon-Meal Organizer viz., Mr.A.Krishnan was transferred from Krishnagiri District to Tuticorin District. If that is so, the petitioner should also be transferred by the first respondent to Vellore District, particularly when the respondents 2 and 3 made appropriate recommendations.

The petitioner had made a representation dated 18.03.2015 to the first respondent to pass an appropriate order transferring her to Vellore District and since the petitioner has not been favoured with any response, she came forward to file this writ petition.

In view of the aforesaid facts, a direction is issued to the first respondent to consider the representation of the petitioner dated 18.03.2015, and pass appropriate orders on merits and in accordance with law, particularly taking note of the recommendations made by the respondents 2 and 3 and also the fact that another Noon-Meal Organizer viz., Mr.A.Krishnan was transferred from Krishnagiri District to Tuticorin District, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
