The Village Administrative officer(VAO) Pakkam village Bhuvaneswaripettai Gudiyatham Tauk Vellore District ..Respondent(s) Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of a writ of mandamus to direct the 3rd respondent to demarcate the house sites and to permit the petitioners to construct their respective house as per their house sites assignment order dated 15.01.2015 and dated 16.11.2011 in Na.Ka.A1.No.2145/95 and Na.Ka.A1/No.2142/95 respectively passed by the 3rd respondent within the time stipulated by this court.

ORDER
Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents.
2. This writ petition has been filed seeking for a direction to the third respondent to survey and demarcate the property owned by the petitioners. Apart from that, the petitioners seek permission for them to construct their
respect house as per the assignment order passed by the third respondent. In respect of this second part of the prayer is concerned, the said relief cannot be granted in this writ petition as it is a separate cause of action.

In respect of survey and demarcation of the property morefully described in the affidavit filed in support of the writ petition is concerned, no prejudice will be caused to the third respondent, if the representations of the petitioners dated 17.09.2025, 25.09.2025 and 12.10.2025 are considered, on merits and in accordance with law, after hearing the objections if any from the neighbouring land owners as well as any other party whom the third respondent deems it fit to enquire. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the land in question, the third respondent is directed to issue notice to the neighbouring land owners, and also to any other party, whom the third respondent deems it fit to enquire.
(b) After receiving objections if any and after considering the same, the third respondent shall conduct survey and demarcate the boundaries of the property morefully described in the affidavit filed in support of this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
(c) If any need arises, the third respondent is permitted to submit a petition for police assistance, and upon receipt of such request, the concerned jurisdictional police shall render necessary police assistance for conducting survey and demarcation of the subject property.
