No counter has been brought on record, though a copy has been supplied to the petitioner.
2.Learned counsel for the petitioner states that out of the panel of five Arbitrators, he had suggested three names and a fourth name in case one of the three is not available. Learned counsel for the respondent states that the panel has been changed and out of the four people suggested by the petitioner, only two are available. He submits that there are two new members in the panel. 3.Learned counsel for the petitioner states that the two member available out of the five in the earlier panel list, as suggested by the petitioner, may be appointed and any one of the remaining two, who are now brought in the panel, may be appointed by the respondent. This would constitute a Three-member Tribunal. 4.In view of the Tribunal already being constituted as aforesaid, no directions are required in this petition and the petition stands disposed of accordingly. No costs.
