ORDER

[This matter has been heard through video conference] This writ petition has been filed seeking a direction to the respondents to settle the award amount in respect of Award No.21/1999-2000 in Na.Ka.No.A1/772/1999 dated 23.03.2000 to the petitioner with interest and compensation for delayed payment.

2. The case of the petitioner is that her land measuring an extent of 0.17.0 Hectares was acquired by the respondent for expansion of burial ground and an award was also passed on 23.03.2000. The grievance of the petitioner is that though the

land was acquired long back and award was also passed, no compensation has been paid to the petitioner till date. Hence, the present writ petition.

Today, when the matter is taken up for hearing, the learned Government Advocate appearing for the respondents, on instructions, submitted that after acquisition of the land, an Award was passed on 23.03.2000 and as the petitioner did not come forward to receive the amount, the same ordered to be deposited in revenue deposit and the same was accordingly deposited into the Sub Treasury on 22.06.2000 itself. Therefore, the petitioner may be directed to approach the 2nd respondent by way of appropriate application seeking for the disbursement of the compensation amount in her favour and in that event, the 2nd respondent may be directed to consider the application of the petitioner within a reasonable time.

4. The learned counsel appearing for the petitioner also submitted that the petitioner would be satisfied, if a suitable directions is issued to the 2nd respondent for the disbursement of the compensation amount.

Considering the submissions made on either side, without expressing anything on merits of the claim of the petitioner, this court directs the petitioner to make an appropriate application to the 2nd respondent seeking to disburse the compensation awarded for the land acquired from her within a period of two weeks from the date of receipt of a copy of this order and in the event of filing of such application, the 2nd respondent is directed to withdraw the compensation amount payable to the petitioner, which is stated to be lying in revenue deposit and disburse the same in favour of the petitioner on proper identification within a period of four weeks thereafter. This writ petition is disposed of accordingly with the above directions. No costs.
