O R D E R
The petitioner/Educational Institution seeks for a mandamus directing the respondent/University to approve the students of M.Ed., Course of the academic year 2014-2015 admitted at the petitioner's college for completing their course and to award degree on their successful completion in the University examination.
2. After notice, this matter was adjourned on several occasions and thereafter, it is listed before this Court, today.
3. The learned counsel appearing for the petitioner submitted that after filing the writ petition, the students of
the petitioner's college have been permitted to appear for the examination in M.Ed., degree course and their results were also published. He further submitted that the respondent/University is yet to conduct the Viva examination for these students, who passed the written examination and unless such Viva is conducted the full fledged degree certificate will not be given. 4.
The learned counsel appearing for the respondent/University filed a counter, wherein, it is stated that the students admitted during the academic year 2014-2015 in the petitioner's college were permitted to appear for the examination, and that their results were also published. Insofar as the claim of the petitioner for conducting Viva examinations is concerned, the learned standing counsel for the respondent/University, based on instructions, submitted that if the petitioner's college makes an application for conducting such Viva, the University will conduct the same, provided necessary fees are paid for conducting such Viva examination.
5. The learned counsel for the petitioner submitted that necessary application will be given to the University along with necessary fees.
6. Considering the above said submissions made by the respective counsels and considering the fact that the examinations were already conducted and the results were also declared, this writ petition is disposed of, with the following directions:
(a) The petitioner shall make an application with necessary fees for conducting Viva examination for the respective students, (who passed M.Ed., degree course, during the academic year 20142015) within a period of four weeks from the date of receipt of a copy of this order.
(b) on receipt of such application and necessary fees, the respondent/University will conduct Viva examination, within a period of two weeks thereafter.
(c) After conducting the Viva examination and based on the results of such Viva, the respondent/University will issue the necessary degree certificate to the candidates, who are successful in both the examinations.
No costs.
