Respondent Prayer: This application is filed under Order XIV Rule 8 of Rules of the High Court, 1994, r/w Order XXXVIII Rule 5 of CPC, to direct the respondent to furnish security for a sum of Rs.2,84,24,000/- (Rupees Two Crores Eighty Four Lakhs and Twenty Four Thousand only), failing which an order of attachment before judgment of immovable properties belonging to the respondent/defendant more fully described in the schedule to the Judges Summons.

ORDER

The application in A.No.1263 of 2020 has been filed seeking directions to the respondent to furnish security and O.A.No.184 of 2020 has been filed seeking interim injunction restraining the defendant from alienating the

schedule mentioned properties.

This Court vide its order dated 23.08.2022 recorded the submissions made by the learned counsel for the respondent/defendant and the relevant portion of the order is extracted hereunder: "2. However, learned counsel for the respondent would submit that his client has no intention to alienate the property and the same is also stated in paragraph 11 of his counter-affidavit filed in A.No.1263 of 2020, which reads as follows:- "11. I do not have any intention to alienate or encumber the properties. I never made any such attempts. The apprehension of the applicant is without any basis when the original title deeds relating to the properties are in possession of the applicant's son." In view of the above, no further orders are required to be passed in these applications and the applications in A.No.1263 of 2020 and O.A.No.184 of 2020 are hereby closed.

The respondent/defendant filed an application in A.No.2083 of 2020 seeking leave to defend the suit. Hence Registry is directed to post the

matter before the learned Master for passing appropriate orders in the said application.
