Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for records of the 2nd respondent in FL/2024/0123/31/004767 dated 07.01.2025 1/7
and to quash the same and consequentially direct the respondents 1 to 4 to survey the cart track in S nos.41/3A2, 3B2, 4C and 51/2A in Vannapatti Village, Uthangarai Taluk, Krishnagiri district. For Petitioner : Mr.J.Pradeep For Respondents 1 to 3 : Mr.S.Arumugam Government Advocate For Respondent-4 : Mr.R.Venkatesa Perumal Government Advocate (Crl.Side) Order Challenging the order dated 07.01.2025 passed by the second respondent, whereby, the second respondent refused to conduct the survey of the petitioner's property (morefully described in the prayer to this writ petition) the present Writ Petition is filed seeking to quash the said order and consequently, to direct the respondents 1 to 4 to survey the petitioner's property
2. The petitioner contends that he is the absolute owner of the property (morefully described in the prayer to this writ petition). The petitioner submitted an application through on-line seeking for survey of his 2/7
property (morefully described in the prayer to this writ petition) and also paid required fees for the said purpose. According to the petitioner, both RDO as also the Assistant Director of the Tamil Nadu Land Survey and Registration Department have issued communications to the first respondent, instructing him to proceed with the petitioner's request for survey and demarcation. However, the second respondent by virtue of the impugned order dated 07.01.2025 refused to conduct the survey and rejected the petitioner's request on the ground of objections received from joint patta holders, viz., respondents 5 & 6, which necessitated the petitioner to approach this Court by way of present Writ Petition.

Mr.S,Arumugam, learned Government Advocate accepts notice on behalf of the respondents 1 to 3 Since objections were raised from the respondents 5 and 6, the second respondent under the impugned order refused to survey the petitioner's property. However, Mr.S.Arumugam, learned Government Advocate fairly submits that since such refusal has been made without conducting any enquiry, direction may be issued by this Court directing the respondents to consider the petitioner's request, which would be complied with, after issuing notice to the objectors, viz. respondents 5 & 3/7
6 and after conducting enquiry, suitable decision would be taken on the request of the petitioner to survey the petitioner's property and demarcate the boundaries.

Mr.R.Venkatesaperumal, learned Government Advocate accepts notice for the fourth respondent and he would submit that the respondentPolice would render all possible assistance, enabling the revenue officials to survey the petitioner's property, if they deem it fit to do so after holding an enquiry.

This Court, after taking into consideration the submissions made on either side, is of the view that no prejudice will be caused to the respondents 5 & 6, if the said respondents 1 to 3 are directed to consider the petitioner's request for survey and demarcation of the boundaries of the petitioner's property morefully described in the prayer to this writ petition, after hearing the objections from the respondents 5 & 6 as well as from any other party as they deem fit.

6. Accordingly, this writ petition is disposed of in the following manner:- (a) The impugned order dated 07.01.2025 passed by the second respondent is set aside.
(b) The second respondent is directed to issue notice to the respondents 5 and 6 and also to any other third party, whom, the second respondent deems fit to put on notice.
b) After receiving objections if any and after considering the same, the second respondent shall conduct survey and demarcate the boundaries of the property morefully descried in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
c) The Official Respondents are at liberty to seek the assistance of the Police Officials, if required, in which case, the concerned Jurisdictional Police is directed to render all assistance for survey and demarcation of the subject property by the official respondents.
7. With the aforesaid directions, this Writ Petition is disposed of, as stated supra. No Costs. Consequently, connected Miscellaneous Petition is closed.
