Fresh notice on the second respondent was directed to be issued by the Court on 29.01.2021 and the notice returned with endorsement "left". The second respondent is only a formal party. Accordingly, this application seeking to condone the delay of 69 days in filing the appeal, is considered. Finding reasons given in the affidavit filed in support of the application, to be justified, the delay is condoned, more so, none is there to contest the application. The application is accordingly allowed.
