ORDER

The petitioner, who was arrested and remanded to judicial custody on 11.02.2026 for the alleged offences under Sections 296(b), 126(2), 351(3) and

103(1) of B.N.S. in Crime No.500 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that due to the previous enmity regarding a suicidal death in the village, A1 along with A2 and A3 abused the deceased Sudhakar and attacked him with deadly weapons and caused death to him. Hence, this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been under incarceration under 24.12.2025 and investigation would have been completed by this time.

At this juncture, the learned Government Advocate appearing for the respondent police submitted that this is a case of murder committed by a group of people on the ground that the deceased has informed to the police in respect of a suicidal death of one of the villagers, thereby necessitated to do postmortem to that body, and as a consequence to which, they have murdered the deceased. Though the learned Government Advocate submitted that there are previous cases against the petitioner, he fairly submits that those previous cases are not serious in nature and also would submit that investigation in this case has already been completed.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. In such view of the position, this Court is of the opinion that the petitioner may be enlarged on bail and therefore, this Court is inclined to grant bail to the petitioner, subject to certain conditions:

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Judicial Magistrate, Arni, Tiruvannamalai and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall Stay at Madurai and report before the Thallakulam police daily at 10.30 a.m. until further orders; [c] the petitioner shall not abscond either during investigation or trial; [d] the petitioner shall not tamper with the evidence or witness either during investigation or trial;

[e] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the

petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]:

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
