Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure prays to call for the records relating to the case in C.C.No. 251 of 2022 pending trial on the file of the Chief Metropolitan Magistrate Court, Egmore, and quash the same. O R D E R

This Criminal Original Petition is filed seeking to quash the C.C.No. 251 of 2022 pending trial before the Chief Metropolitan Magistrate Court, Egmore, Chennai.

2. Earlier this Court directed the petitioners to deposit a sum of Rs.58,00,000/- (Rupees Fifty Eight Lakh Only) to the credit of Crime No. 467 of 2015 before the Trial Court within a period of two weeks from the date of receipt of a copy of that order.

3. Today, when the matter came up for hearing, both the learned

Counsels are present.

4. The learned Counsel for the petitioners has produced a xerox copy of the Demand Draft worth about Rs.58,00,000/- [Rupees Fifty Eight Lakh Only] bearing No.024751, dated 30.07.2024 in favour of the learned Chief Metropolitan Magistrate, Egmore, Chennai, as One Time Settlement the petitioners have already agreed before this Court.

5. The learned Counsel for the De-facto complainant has also produced a copy of the Board Resolution dated 14.11.2014 before this Court and the same was also recorded.

6. Since the matter has been settled between the parties, the impugned C.C.No. 251 of 2022 pending trial before the learned Chief Metropolitan Magistrate, Egmore, Chennai, is hereby quashed.

7. Accordingly, this Criminal Original Petition is allowed. Further, the Trial Court is directed to return the aforesaid deposited amount to the Defacto Complainant in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. Consequently, connected Miscellaneous Petition is also closed.
