ORDER

Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

In view of the respective contentions raised herein, this Court directs the third respondent police viz., The Inspector of Police Kondalampatti Police Station, Kondalampatti, Salem, to re-open the enquiry on the petitioner's complaint dated 11.06.2015 and to hold fresh enquiry in the presence of the parties and to proceed with the direction of the Hon'ble Apex Court in (2014) 2 SCC 1 (Lalita Kumari v. Government of Uttar Pradesh and others) and the petitioner is directed to co-operate with the respondent police for enquiry as and when required. The third respondent police is also directed to consider affording police protection to the petitioner's company to vacate and remove the cell phone tower and its related all electrical & electronics equipments from the premises at No.25, Rangichetti

3. With the above directions, this Criminal Original Petition is disposed of.
