PRAYER: This criminal miscellaneous petition has been filed under Section 528 of the B.N.S.S, 2023, to modify the condition in para no.5(b) imposed in Crl.O.P.No.799 of 2025 dated 20.01.2025. For Petitioner(s):

ORDER

The petitioner seeks modification of the condition in para no.5(b) imposed in Crl.O.P.799 of 2025 dated 20.01.2025 directs him to appear before the respondent Police every day at 10.30 a.m., until further orders.

2. The learned counsel for the petitioner submitted that the petitioner had appeared before the respondent police in compliance with the order dated 20.01.2025 for a period of one week and thereafter, he met with an accident and suffered multiple bone fractures in his right leg and therefore, he is unable to appear before the respondent police and seeks modification.

3. The learned Government Advocate (Crl.Side) for the respondent police, on instructions, submitted that the petitioner had appeared before the respondent police for a period of seven days.

4. In view of the medical condition, this Court modifies the condition. Hence, the petitioner is directed to appear before the respondent police Page No.2 of 4

once a week i.e., on every Saturday @ 10.30 a.m. until further orders The other conditions imposed in the order dated 20.01.2025 in Crl.O.P. No.799 of 2025 shall remain unaltered.

5. Accordingly, the criminal original petition is ordered, and the condition is modified.
