ORDER
These Civil Revision Petitions have been filed seeking to set aside the Common and Final order dated 7.11.2025 passed in IA.No.10 & 11/2025 in OS.No. 380/2016 on the file of the District Munsif, Dharapuram.
2. The petitioners herein filed IA.No.10 & 11/2025 in OS.No. 380/2016 on the file of the District Munsif, Dharapuram, under Order XVIII Rule, 17 CPC seeking to reopen the stage of case and for recall of the PW.1 for the purpose of marking of document. Upon hearing both sides, the Trial Court dismissed the applications by holding that the petitioners have not filed the applications with bonafide mind and clean hands.
3. Aggrieved over the same, the petitioners filed these Civil Revision Petitions.
4. The learned counsel for the petitioners submit that at the time of examination of P.w.1 he omitted to produce some documents. Now, the P.W.1 wants to produce the same. If opportunity is not given to the petitioners, their valuable right to prove the case will be defeated. Hence, he prays to allow this
petition.
4.1. The learned Government Advocate raised objection to allow these petitions.
5. Heard both sides.
6. On perusal of records, it reveals that the petitioners have filed the suit for the relief of declaration in the year 2016 against the State and other individual. If the opportunity is not given to the petitioners their valuable right will be defeated. Hence, the order passed by the Trial Court in IA.No.10 & 11/2025 in OS.No. 380/2016 is set aside. Thus, IA.No.10 & 11/2025 in OS.No. 380/2016 on the file of the District Munsif, Dharapuram is allowed.
