O R D E R

This Criminal Original Petition has been filed to quash the proceedings in C.C.No.333 of 2025 pending on the file of the Judicial Magistrate, Vanur.

2. The learned counsel for the petitioner submitted that the petitioner is a tourist car driver, the passenger, who was travelling in the car, was carrying certain liquor bottles without the knowledge of the petitioner. However, the petitioner alone has been arrayed as an accused. Hence, the present petition has been filed.

3. The learned Additional Public Prosecutor appearing for the respondents submitted that during the road check conducted on 20.10.2024 at about 4.00 p.m., the petitioner's vehicle was intercepted. The petitioner was found driving the vehicle and upon inspection, Courrier Napoleon Brandy 180ML-48 bottles, and Mansion House Brandy 750ML-1 were found and seized. Thereafter, an FIR was registered on the same day in Crime No.145 of 2024. On completion of investigation, a charge sheet was filed on 31.01.2025, listing six witnesses .

4. The contention raised by the petitioner are factual in nature and it is for the petitioner to adduce evidence in support of his contentions, which cannot be adjudicated at this stage.

5. Considering the submissions made, this Court is of the opinion that the points raised by the petitioner do not merit consideration.

6. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed. 16-03-2026 AT To:
