C.M.P.No.8954 of 2018 in C.M.A.No.SR.36080 of 2018 V.M.VELUMANI,J.

This petition is filed to condone the delay of 108 days in filing the above Civil Miscellaneous Appeal.

2.Though notice was served on the first respondent and her name is printed in the cause list, there is no representation on behalf of the first respondent either in person or through counsel.

3.Mr.T.Ravichandran, the learned counsel takes notice for the fourth respondent/United India Insurance Company.

4.The learned counsel for the petitioner/appellant submitted that the respondents 2, 3, 5 and 6 remained exparte before the Tribunal and hence, no notice is necessary for them.

5.Considering the contention of the learned counsel for the petitioner, the delay of 108 days is condoned on payment of cost of Rs.500/- (Rupees Five Hundred only) to the 'High Court Legal Services Authority, Chennai', within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically, without further reference to this Court.
