ORDER
This Writ Petition has been filed to direct the 1st respondent to act upon the representation of the petitioner dated 29.07.2025 requesting the 1st respondent not to register any document in respect of the property morefully disclosed in the prayer to this writ petition.
2. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice on behalf of the respondents 1 and 2. Since no adverse order is passed against the respondents 3 and 4 in this writ petition, notice to the respondents 3 and 4 is dispensed with by this Court.
3. According to the petitioner, a civil suit is pending in respect of the property morefully disclosed in the prayer to this writ petition. According to him, he is the plaintiff in the said civil suit. He had submitted a representation on 29.07.2025 to the 1st respondent raising objections for registration of any document by the 1st respondent Page No.2 of 6
pertaining to the property morefully disclosed in the prayer to this writ petition. Since the said representation was not considered, the petitioner has filed this writ petition.

Learned Special Government Pleader appearing for the respondents 1 and 2 drew the attention of this Court to the order, dated 05.08.2025 passed by the 1st respondent, which has been filed by the petitioner along with this writ petition and would submit that it is clear from the said order that the 1st respondent has already rejected the representation of the petitioner by directing the petitioner to approach the civil court.
5. However, as seen from the said order, dated 05.08.2025, it is not known as to whether the document has been released to the executant or not. Since the petitioner has raised objections with regard to any document pertaining to the property morefully disclosed in the prayer to this writ petition on account of the fact that the petitioner has already filed a civil suit in respect of the very same property, this Court disposes of this writ petition by directing the respondents 1 and 2, in case the Page No.3 of 6
registered document executed by a third party has not been released to the said third party, to afford an opportunity of hearing to the petitioner before registering the document presented by the third party for registration and only after giving due consideration to the objections raised by the petitioner, the 2nd respondent shall take a final decision as to whether the document presented by the third party pertaining to the very same property which is the subject matter of this writ petition can be registered or not. However, it is made clear that if the document has already been registered and released to the third party, the petitioner will have to workout his further remedies in the manner known to the petitioner under law. No costs.
