ORDER

The criminal original petition has been filed to direct the Principal District and Sessions Judge, Tiruvarur to consider the bail application of the petitioner on the same day of his surrender in Cr.No.39/2026 on the file of the respondent police 2.Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the first and second respondents.

3.Considering the submissions made and on perusal of the materials, it is seen that the petitioner/A1 in Crime No.39 of 2026, the petitioner, who was working as Contractor under the Rural Development and Panchayat Schemes had entered into a Panchayat Office when the defacto complainant was conducting a Village Meeting with regard to Kalaignar Kanavu Illam Scheme.

At that time, the petitioner asked the defacto complainant to immediately take steps to issue a work order with regard to sewage water connection. The defacto complainant informed the petitioner that, such an order could be issued only after obtaining approval orders from the Block Development Officer. Upon hearing this, the petitioner became enraged and allegedly assaulted the defacto complainant with a chair and abused him by calling out his caste name, stating that a person belonging to such caste should not sit in that office and hold such work and thereafter he has taken to the hospital by the villagers. 4.

In view of the above factual position, there shall be a direction to the the Principal District and Sessions Judge, Tiruvarur, to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.39 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victim under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
