ORDER

This criminal original petition has been filed praying to quash the proceedings in Spl.CC.No.28 of 2020 on the file of the Special

court for Exclusive Trail of POCSO Cases, Coimbatore. 2.

The petitioner is the accused and he is facing charges for the offence punishable under sections 5(l), 5(j)(ii), 6 of POCSO Act, 3(2)(v), 3(1)(w)(i) of SC/ST Act, 376(3), 506(i) of IPC. The petitioner filed this petition on the ground of compromise for the reason he got married the victim girl and their marriage was also registered before the registering authority. On the strength of the registration of marriage, the victim girl also entered into box before the trial court as PW1 and turned hostile. However, this Court directed the first respondent for production of the victim girl before this Court. The victim girl appeared before this Court and deposed that at her teenage, she deposed before the trial court that she wanted to live with the petitioner. However, after registration of marriage, the petitioner is torturing the victim girl to the core and is involving in various illegalities. Therefore, she wants to proceed with the case in accordance with law. Further, she does not want to live with the petitioner herein.

It is seen that so far the prosecution has examined witnesses i.e. PW1 to PW19 in support of the charges. Therefore, this Court is not inclined to quash the impugned proceedings. Accordingly, this criminal

original petition is dismissed. It is made clear that the trial court shall permit the victim girl for re-examination and complete the trial within a period of three months from the date of receipt of this order. Further, if any complaint is lodged by the victim girl on the allegation of torture and any illegality committed by the petitioner, the first respondent is directed to register FIR against the petitioner and proceed in accordance with law.
