Prayer: Criminal Original Petition has been filed under section 482 of Criminal Procedure Code to call for the records pertaining to C.C.No.2393 of 2019 pending on the file of the learned Judicial Magistrate No.VI at Coimbatore and quash the same in so far as the petitioner herein is concerned.

The petitioner herein, who absconded during the trial, is now before this Court to quash the split-up case in C.C.No.2393 of 2019 on the ground that the accused in the main case has been acquitted after trial.

2. Learned Government Advocate (Crl.Side) appearing for the 1st respondent states that the petitioner is still absconding and has not subjected himself to trial. The case is now adjourned to 23.05.2024, for his appearance. If he appears and participates in the trial, the Trial Court will follow the judgment of the Hon'ble Supreme Court and if there is parity between the petitioner and the other accused, who have already been acquitted after trial, appropriate orders will be passed.

3. In view of the above fact, the Criminal Original Petition is disposed of directing the petitioner herein to submit himself before the Trial Court and make all his submissions before the Trial Court for appropriate orders. Consequently, the connected criminal miscellaneous petition is closed.
