ORDER

This Criminal Revision Petition has been filed to set aside the order of dismissal dated 12.11.2025 made in Crl.M.P.No.6711 of 2025 on the file of the Judicial Magistrate-1, Salem by allowing this Criminal Revision Petition.

2. The learned counsel for the petitioner would submit that the petitioner is a power of attorney holder of the owner of the vehicle. While looking into the impugned order, the learned Magistrate is of the view that the vehicle cannot be handed over except to the owner. Admittedly no valid reason assigned either before the learned Magistrate or before this Court as to why, the owner of the vehicle namely, Thangamuthu is not party to the proceeding.

3. Hence, this Court is of the view that there is no palpable error in the order passed by the learned Magistrate.

4. Accordingly, the present Criminal Revision Petition is dismissed. However, the petitioner is given liberty to move an appropriate application through the owner of the vehicle.
