Appeal suit filed under Section 96 of the Civil Procedure Code, against the judgment and decree of the learned Additional District Judge, Namakkal, dated 26.07.2017 made in O.S. No.122 of 2016.

2. Mr.S.Kalyanaraman, learned counsel appearing for the appellant, placed before us a letter written by the appellant dated Nil requesting him to withdraw the appeal, as not pressed. Since the matter has been resolved, the learned counsel appearing for the appellant submitted that the appeal may be dismissed as not pressed.

3. Recording the submission made by the learned counsel appearing for the appellant and the letter written by the appellant, the appeal suit is dismissed as withdrawn. However, there shall be no order as to costs. As the appeal has been withdrawn, the appellant is entitled to get 50% of the court fee paid by her. Registry, is directed to refund the court fee, as applicable.
