Writ Petition filed under Article 226 of the Constitution of India seeking an order in the nature of a writ of mandamus directing the respondent to consider the representation of the petitioner and her husband dated 09.2.2015 and 27.04.2015 and pass orders in accordance with law, under the Tamil Nadu Land Encroachment Act to secure the ends of justice.

ORDER

(Order of the Court was made by S. TAMILVANAN, J.) Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondent.

2. This writ petition has been filed seeking an order to issue a writ of mandamus directing the respondent to consider the representations made by the petitioner and her husband dated https://hcservices.ecourts.gov.in/hcservices/

09.2.2015 and 27.04.2015, in accordance with law under the Tamil Nadu Land Encroachment Act.

3. Learned counsel appearing for the petitioner submits that it would be suffice if a direction is given to the respondent to consider the representations made by the petitioner and her husband and pass appropriate orders within the time prescribed by this Court.

Considering the limited scope of the relief sought for by the petitioner, without going into the merits of the case, we direct the respondent to consider the representation made by the petitioner in accordance with law. The petitioner is also permitted to furnish a copy of the representations dated 09.2.2015 and 27.04.2015 to the respondent within a period of 10 days from the date of receipt of a copy of this order and thereafter, the respondent shall consider and pass appropriate orders on the petitioner's representations dated 09.02.2015 and 27.04.2015, on merits and in accordance with law, after affording reasonable opportunity to the petitioner and the rival claimants, if any, within a period of eight weeks.
