CMP No.8285 of 2019 in SA SR No.34424 of 2019 CMP No.8285 of 2019 in SA SR No.34424 of 2019 R.SUBRAMANIAN, J The petitioner seeks condonation of delay of 302 days in filing the Appeal. The reasons for the delay are that the petitioner is unable to file the Appeal in time, due to his old age, ill health and financial constraints. It is also stated that the petitioner has not gained anything by causing the delay and no prejudice would be caused to the respondents by condoning the delay.

2. Considering the reasons assigned and the age of the petitioner, I am of the opinion that he should be given an opportunity to prosecute the Appeal on merits. I find that the petitioner has satisfactorily explained the delay. However, the respondents will have to be compensated for the delay. Hence this petition is allowed on condition that the petitioner pays a cost of Rs.3,000/- to the learned counsel for the respondents appearing in this Court on or before 14.12.2020.

Post on 15.12.2020 for compliance.
