O R D E R

This writ petition has been filed for a Mandamus seeking for a direction to the respondent to grant permission to the petitioner to conduct Aadal Paadal Dance program scheduled to be held on 09.04.2021 at Sri Kulavizhakku Amman Temple Thidal, Nanjaikalamangalam Village, Modakurichi Taluk, Erode District by considering the petitioner's representation dated 19.03.2021.

2. Mr.V.Shanmuga Sundar, learned Special Government Pleader accepts notice on behalf of the respondent. By consent of both parties, this writ petition is taken up for final disposal at the time of admission itself.

3. Heard Mr.P.Kannan Kumar, learned counsel for the petitioner and Mr.V.Shanmuga Sundar, learned Special Government Pleader appearing for the respondent.

4. The petitioner submits that he is a resident of Uthandipalayam Village and coordinator for the Village Committee which organizes regularly the festivals at Sri Kulavizhakku Amman Temple Thidal, Nanjaikalamangalam Village, Modakurichi Taluk, Erode District. He has given a representation on 19.03.2021 seeking permission of the respondent to conduct the dance program in the aforementioned temple on 09.04.2021. https://hcservices.ecourts.gov.in/hcservices/

Admittedly, the said representation has not been considered till date on merits and in accordance with law.

5. Learned Special Government Pleader on instructions would submit that due to ensuing elections, the petitioner will have to approach the election commission and the respondent cannot grant permission for the petitioner to conduct the said festival.

Since the representation of the petitioner has not been considered till date, this Court is of the considered view that no prejudice will be caused to the respondent, if the petitioner's representation is considered on merits and in accordance with law before the scheduled date of the festival i.e., on 09.04.2021.

7. For the foregoing reasons, this Court directs the respondent to consider the petitioner's representation dated 19.03.2021 seeking permission to conduct Aadal Paadal dance program at Sri Kulavizhakku Amman Temple Thidal, Nanjaikalamangalam Village, Modakurichi Taluk, Erode District and pass final orders on merits and in accordance with law on or before 05.04.2021.

8. With the aforesaid direction, this writ petition is disposed of. No costs.
