O R D E R

This is the second anticipatory bail application filed by the petitioner before this Court.

2. Though the earlier anticipatory bail petition of the petitioner was dismissed by my learned predecessor, Hon'ble Justice A.D.Jagadish Chandira, this petition is listed before this Court pursuant to the orders passed by the Hon'ble Division Bench of this Court in Crl.O.P.No.31787 of 2024 on 04.03.2025.

3. The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section Section 8(c) r/w Sections 20(b)(ii)(B), 25 and 29(1) of NDPS Act, in Crime No.347 of 2024, on the file of the respondent police, seeks anticipatory bail.

4. The case of the prosecution is that, the co-accused was found in possession of 8.580 kgs of Ganja and the petitioner was implicated on the Page No.2 of 5

confession of the co-accused.

5. Learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case and prayed for anticipatory bail to the petitioner; and that although the earlier petition was dismissed on 09.01.2025, the petitioner has not been arrested so far.

6. The learned Government Advocate (Crl. Side) submitted that the earlier anticipatory bail application was dismissed as withdrawn by this Court on 09.01.2025 by my learned predecessor, Hon'ble Justice A.D.Jagadish Chandira, considering the petitioner's involvement in three previous cases under the NDPS Act; and that there is no change in circumstances since then.

7. Considering the aforesaid submissions, the bad antecedents of the petitioner and since there is no change in circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
