The petitioners who apprehend arrest at the hands of the respondent police for the offences punishable under sections 406, 409, 420, 120(B) IPC and section 5 of TNPID Act in Crime No.4 of 2022, seek anticipatory bail.
2.The case of the prosecution as per the defacto complainant Yogalakshmi is that accused A1 and A2 are the Directors in GDR Sun Enterprises, and A3 is the Authorised Signatory of the said company. The accused had induced the defacto complainant on the promise by giving good returns and received an amount of Rs.2,39,000/- from her and cheated her. Further allegation is that during the course of the investigation, it came to light that the accused have received deposits from 71 depositors and cheated them to the tune of Rs.5.50 Crores. Hence the complaint.
3.The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely roped in this case. He would submit that first petitioner is the brother of A1 and the second petitioner is the wife of first petitioner, since they are only brother and sister-in-law of A1, have been falsely implicated in this case, other than relatives, they do not have any connection with the main accused. Hence, he prays to grant anticipatory bail to the petitioners. 4.The learned Government Advocate(Crl.Side) would submit that the first petitioner is the Director and the second petitioner is the Authorised Signatory of GDR Sun Enterprises. He would submit that the petitioners along with A1 have received deposits from 71 depositors and cheated them to the tune of Rs.5.50 Crores. He would submit that investigation is at the nascent stage and A1 is still in the custody. Hence, he opposed to grant bail to the petitioners.
5. Taking in to consideration that A1 was arrested and still in the custody and the investigation is at the nascent stage, this Court is not
inclined to grant bail to the petitioners.
6. Accordingly, this Criminal Original Petition is dismissed. 31.03.2023 mpa
