ORDER

This Criminal Original Petition has been filed by the petitioner seeking expeditious disposal of C.C.No.101 of 2018 pending on the file of the learned Judicial Magistrate Court No.II, Chengalpattu, within a stipulated time. 2.

Learned counsel appearing for the petitioner submitted that based on the complaint lodged by the petitioner/de facto complainant, the third respondent police registered a case in Crime No.31 of 2015 for the offences punishable under Sections 120(b), 419, 423, 465, 468, 471 and 420 of IPC. He further submitted that upon completion of investigation, a final report was filed and the same was taken cognizance on the file of the Judicial Magistrate No.II, Chengalpattu, in C.C.No.101 of 2018. However, the accused are not cooperating for the conduct of trial and the matter is still pending. Therefore, the learned counsel appearing for the petitioner prayed that this Court may be pleased to direct expeditious disposal of the said case. 3.

The learned Additional Public Prosecutor appearing for the respondents submitted that there are totally 12 witnesses cited in this case. Out of them, the prosecution has examined material witnesses from P.W.1 to P.W.8. The case is now posted for examination of P.W.9, the Investigating Officer. He further submitted that there is no delay on the part of the prosecution and that the prosecution will fully cooperate for the early completion of trial.

Heard the learned counsel on either side and perused the materials available on record.

On perusal of the records, it is seen that the Investigating Officer/P.W.9 is presently under examination and upon completion of the same, the prosecution evidence would be closed. Thereafter, it is for the trial Court to examine the accused under Section 313 Cr.P.C., to hear the defence, if any and proceed to dispose of the case on merits. Considering the stage of the case, this Court is inclined to direct the trial Court to complete the trial within a period of two months from the date of receipt of a copy of this order. 6.

With the above directions, this Criminal Original Petition stands disposed of.
