Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the 2nd respondent to execute the order dated 12.10.2019 in Rc.J14/8386/2019 along with police protection.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) After arguing for some time, learned counsel for the petitioner submitted that the possession of the secured asset has not been handed over to the petitioner/secured creditor, in spite of the fact that order under Section 14 of the SARFAESI Act has already been passed. He prays for liberty to approach the 1st respondent for filing an application under Section 14 (2) of the SARFAESI Act seeking implementation of the order passed under Section 14 of the Act.

2. If the petitioner approaches the first respondent within a period of fifteen days, the application shall be considered in

accordance with law and the first respondent shall ensure the handing over of the possession to the petitioner/secured creditor. The writ petition is, accordingly, disposed of. There shall be no order as to costs.
