ORDER

This Civil Revision Petition has been filed seeking to set aside the fair and decretal order dated 12.01.2023 passed in I.A.No. 1 of 2022 in ASSR.No. 26209 of 2017 against O.S.No. 5841 of 2013 by the learned Principal Judge, City Civil Court, Chennai and for a direction to number the appeal to be taken on file.

Today, when the matter was taken up for hearing, the learned counsel for the petitioners filed an affidavit, dated 18.07.2023, wherein, it has been stated that the suit in O.S.No. 5841 of 2013 was filed by the respondent/plaintiff for recovery of money a sum of Rs.9,55,380/- against the petitioners/defendants. During the pendency of the revision, both parties have mutually agreed to compromise the issue involed in question by making payment of Rs.10,00,000/- as full and final settlement in view of the Judgment and Decree passed by the learned VIII Assistant Judge, City Civil Court, Chennai, dated 21.10.2016. The aforesaid amount will be paid in six installments commencing from August, 2023.

In view of the above compromise entered into between the parties as well as the affidavit submitted by the learned counsel for the petitioners, the Civil Revision Petition is disposed of. If the petitioners have not paid the aforesaid amount, the Decree Holder is at liberty to proceed further in the manner known to law. Consequently, connected Miscellaneous Petition is closed. No costs.
