Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, direct the 3rd respondent to consider and dispose of the petitioner's online application dated 10.02.2026 seeking sub-division/patta transfer of the property in S.No.44/2A1A1measuring 2.40 Acres situated at Kumarapettai Village, Cuddalore District, within a time frame to be fixed by this Court, and consequently direct the 3rd and 4th respondents to conduct survey of the petitioner's land with the aid of the 5th respondent. ORDER

This Writ Petition has been filed to direct the 3rd respondent to issue sub-division patta for the property morefully disclosed in the prayer to this writ petition in favour of the petitioner, based on the petitioner's application, dated 10.02.2026. The petitioner also seeks for a consequential direction to the respondents 3 and 4 to conduct the survey of the petitioner's sub-divided property with the aid of the 5th respondent.

2. Since the aforesaid application of the petitioner was not considered, the petitioner has filed this writ petition. Page No.2 of 6

Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 to 4 and Mr.R.Venkatesa Perumal, learned Government Advocate (Crl.Side), accepts notice on behalf of the 5th respondent. Since no adverse orders are passed against the respondents 6 and 7 in this writ petition, notice to the respondents 6 and 7 is dispensed with by this Court.

No prejudice would be caused to the respondents, if the petitioner's application as stated supra is considered on merits and in accordance with law, after giving notice to the respondents 6 and 7 and after hearing their objections, if any, within a time frame to be fixed by this Court. No prejudice would also be caused to the respondents, if a direction is issued to the respondents 3 and 4 to conduct survey of the sub-divided property with the aid of 5th respondent in the presence of the respondents 6 and 7. This Court is not expressing any opinion on the merits of the petitioner's application.

5. For the foregoing reasons, this Court directs the 3rd respondent to pass final orders on merits and in accordance with law on the Page No.3 of 6

petitioner's application, dated 10.02.2026 seeking for sub-division of the property morefully disclosed in the prayer to this writ petition, after giving due consideration to the supporting documents filed by the petitioner and after hearing the objections, if any, from the respondents 6 and 7 and any other third party, whom the 3rd respondent deems it fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order. Once the petitioner is entitled for sub-division as prayed for in his application dated 10.02.2026, the respondents 3 and 4 are directed to survey the petitioner's sub-divided property, after giving notice to the respondents 6 and 7, within a period of twelve (12) weeks thereafter.

6. With the aforesaid direction, this Writ Petition is disposed of. No costs.
