JUDGMENT

Today, learned counsel appearing for the appellant has filed a memo stating that he had already deposited a sum of Rs.2,00,000/- and again, as per the order of this Court dated 06.02.2025, he has deposited a sum of Rs.2,87,000/- to the credit of the main appeal and therefore, he prays to permit to withdraw this second appeal.

3. In view of the submission and endorsement made by the learned counsel for the appellant, this Second Appeal is dismissed as withdrawn. Consequently, connected miscellaneous petitions are closed. No costs.

4. Since notice has not been served to the respondents, if the respondent approaches the court for execution of the decree, at that time, the appellant is at liberty to inform about the deposit of the amount and dismissal of the appeal.

5. The Registry is directed to refund the court fee to the appellant as per the Rules.
