ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus to direct the respondents No.3, 4 and 6 to sanction and disburse the additional charge allowance, travel allowance and dearness allowance to the petitioner for having held full additional charge of the post of Assistant General Manager (Finance) at Thirupathur District Co-Operative Milk Producers Union Ltd with effect from 14.10.2024 together with arrears and interest at the rate of 12% per annum by considering the petitioner's representation dated 27.01.2026.
2. The case of the petitioner is that he was appointed as Manager (Finance) in the year 2014 and was subsequently promoted as Assistant General Manager (Finance) in the year 2021. Since 2023, the petitioner has been in service at Vellore District Cooperative Milk Produces Union Limited. The third respondent entrusted the petitioner with full additional charge of the post of Assistant General Manager (Finance) at Thirupatthur, in addition to his regular duties. Pursuant thereto, the petitioner assumed charge on 14.10.2024 and has been discharging dual responsibilities, travelling approximately 120 kilometres twice a week. Despite performing full addition charge for an extended period without any adverse remarks, the petitioner was not paid additional charge allowance, travel allowance and other admissible benefits. The petitioner made several oral representation and thereafter submitted a detailed representation dated 27.06.2025 seeking sanction of the said allowance. Pursuant thereto, the
second respondent, vide proceedings dated 15.08.2025, directed the 3rd respondent to take appropriate action. Thereafter, the petitioner again submitted a representation on 27.01.2026 to the respondents 1 to 4 seeking sanction and disbursement of the additional charge allowance. However, no response has been received from the respondents. Challenging the inaction on the part of the respondents, the present Writ Petition has been filed.
3. Heard the learned counsel appearing for the petitioner, learned Special Government Pleader for respondent Nos.1 and 2 and the learned Standing Counsel for respondent Nos.3 to 6.
4. The learned counsel for the respondents submitted that the 6th respondent is the authority competent to pass orders on the representation of the petitioner and hence, this Court may issue an appropriate direction to the 6th respondent.
5. Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the 6th respondent to consider the representation given by the petitioner and pass orders, on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.
6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
