The petitioner had earlier filed a writ petition in W.P.No.33890 of 2023 seeking the following relief: 'Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Certiorarified Mandamus, to call for the entire records pertains to impugned order of the 1st 2/6
respondent dated 21.08.2023 made in Na.Ka.Enn724408/2023/Pae2 and quash the same as illegal and further direct the 4th respondent to transfer the petitioner from Vedharajipuram Village to any other Panchayat in Arni Panchayat Union. '
2.The present writ petition has been filed seeking the following relief:
'Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Certiorarified Mandamus, to call for the entire records pertains to impugned order of first respondent dated 21.08.2023, made in Na.Ka.Enn724408/2023/Pae2 and to quash the same and consequently direct the 3rd respondent to transfer the petitioner from Vedharajipuram Village to any other Panchayat in Arni Panchayat Union, Tiruvannamalai District.'
3.It is thus evident that the petitioner has challenged the very same order dated 21.08.2023, passed in Na.Ka.Enn724408/2023/Pae2, in both writ petitions. In the earlier writ petition, a learned Single Judge of this Court was emphatic that the suspension could not be revoked, and 3/6
only a direction was given to pay the subsistence allowance. This particular order cannot be revisited by this Court. As correctly contended on behalf of the respondents, this writ petition constitutes a re-litigation of the same issue before this Court.
4.Accordingly, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 13.03.2025 Index : Yes / No : Yes / No Speaking Order : Yes / No TK 4/6
