Crime No.8/99/AC/KM ..Respondent Prayer:- Criminal Appeal is filed under Section 374(2) of the Cr.P.C. to allow the appeal, set aside the conviction and sentence passed as against the appellant to undergo rigorous imprisonment for one year and sentenced to pay a fine of Rs.5,000/- in default to undergo rigorous imprisonment for six months under Sec.7 of Prevention of Corruption Act, 1988 and to undergo rigorous imprisonment for one year and sentenced to pay a fine of Rs.5,000/- in default to undergo rigorous imprisonment for one year and sentenced to pay a fine of Rs.5,000/- in default to undergo rigorous imprisonment for six months under Sec.13(1)(d) r/w. Sec.13(2) of Prevention of Corruption Act, 1988 in Special case No.4/2000 dated 22.04.2009 by the Special Judge cum Chief Judicial Magistrate, Chengalpattu and acquit the appellant and direct the Trial Court to refund the fine amount.

2. The learned Government Advocate submits that the appellant died on 24.11.2009. The attested Death Certificate of the appellant/accused is also enclosed along with the memo filed by the learned Government Advocate.

3. Recording the same, this criminal appeal is dismissed as abated.
