Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for the issuance of Writ of Mandamus, directing the first respondent to return the New Passport bearing No.Z1758487 and Old Passport bearing No.E8895431 for renewal, which is in custody of Chennai Regional Passport Authority deposited in C.C.No.9660 of 2017 in Cr.No.214 of 2015, u/s 406, 420, 506(i) and 12(b) of IPC, now pending trial.

O R D E R

This writ petition has been filed for a mandamus seeking for a direction to the first respondent to return the New Passport bearing No.Z1758487 and Old Passport bearing No.E8895431 for renewal which is in the custody of Chennai Regional Passport Authority deposited in C.C.No.9660 of 2017 in Cr.No.214 of 2015, u/s 406, 420, 506(i) and 12(b) of IPC.

The learned counsel appearing for the petitioner now submits that the petitioner is willing to approach the Criminal Court in C.C.No.9660 of 2017, which is pending on the file of the CCB & CBCID Metropolitan Magistrate, Egmore @ Allikulam, Chennai. and seek for return of the new Passport bearing No.Z1758487 and Old Passport bearing No.E8895431 in order to obtain renewal. No prejudice would be caused to the respondents, if such liberty is granted by this Court to the petitioner. However, once an application seeking for return of the Passport is filed by the petitioner before the CCB & CBCID Metropolitan Magistrate, Egmore @ Allikulam, Chennai, in C.C.No.9660 of 2017, the said Court will have to consider the same on merits and in accordance with law.

Recording the statement made by the learned counsel appearing for the petitioner, this writ petition is disposed of by granting liberty to the petitioner to approach the CCB & CBCID Metropolitan Magistrate, Egmore @ Allikulam, Chennai, and seek for return of the new Passport bearing No.Z1758487 and Old Passport bearing No.E8895431, which is in the custody of the said Court, by filing an appropriate application.
