PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the first respondent to seize the vehicle named Tata-Hitachi Zaxsis 120 H based on the FIR in Crime No.13 of 2020 dated 28.01.2020 and handover the same to the petitioner.

ORDER

This Criminal Original Petition has been filed for a direction to direct the first respondent to seize the vehicle named Tata-Hitachi Zaxsis 120 H based on the FIR in Crime No.13 of 2020 dated 28.01.2020 and handover the same to the petitioner.

2. The learned Additional Public Prosecutor has submitted that the vehicle has been involved in the sand theft case and as such, the FIR has been registered in Crime No.13 of 2020 for the offence under Sections 379 and 511 of IPC on the file of the respondent police. In this regard that the vehicle has been seized by the Tahsildar, Dharapuram and about to produce before the concerned jurisdictional Magistrate Court.

3. Considering the above facts and circumstances, the respondent is directed to surrender the seized vehicle Tata1/2 https://hcservices.ecourts.gov.in/hcservices/

Hitachi Zaxsis 120 H, in pursuance to the crime No.13 of 2020 before the concerned jurisdictional Magistrate within a period of two weeks from the date of receipt of a copy of this order.

4. With the above direction, this Criminal Original Petition is disposed of.
