Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, directing the first respondent not to interfere in the civil and money dispute and act as recovery agent for respondents No.2 to 5 in connection with the complaint no.1026 /DCSTM/PG/2024 on 26.12.2024.

This Writ Petition has been filed for direction directing the first respondent not to interfere in the civil and money dispute and act as recovery agent for respondents No.2 to 5 in connection with the complaint no.1026 /DCSTM/PG/2024 on 26.12.2024.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the first respondent and perused the materials available on record.

3. It is seen that the petitioner borrowed money from the respondents 2 to 5 herein for interest. However, they are claiming exorbitant interest and as such, the petitioner filed a suit in O.P.No.7 of 2025 on the file of the IX Assistant City Civil Court, Chennai to scale down the interest and it is pending. While being so, the respondents 2 to 5 herein lodged a complaint before the first respondent and it is pending in C.No.1026/DCSTM/PG/2024, on the file of the first respondent. Now, the first respondent called the petitioner and also compelled to settle the loan amount.

4. Already the petitioner filed an OP and it is pending before the civil Court. When it being so, the first respondent has no role to play in the civil

dispute pending between the petitioner and the respondents 2 to 5 herein.

5. In view of the above, the first respondent is directed not to interfere with the money dispute that too in respect of the interest portion between the petitioner and the respondents 2 to 5 herein. However, if any offence is committed by the petitioner or the respondents 2 to 5 herein, the first respondent is at liberty to proceed against them in accordance with law.
