ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The learned Additional Advocate General points out that it was not correctly pointed out to the Court on 23.3.2016 while passing the order that the land did not vest with the Highway Department, but with the Municipality and, thus, the Court direction was passed against the third respondent, though actually the action had to be taken by the fifth respondent. It is stated that this has delayed the process.

2. We may also note that the direction of the Court was only to proceed in accordance with law for removal of any alleged encroachment. The action has subsequently been taken by issuance of notice and passing of orders, which in turn was assailed by the affected sixth respondent in the writ petition.
