Prayer: Writ Petition is filed under Article 226 of the Constitution of India for the issuance of Writ of Mandamus directing the 1st respondent to forthwith disburse the death-cum-retirement benefits including GPF, DCRG ad all other terminal benefits payable on account of the death of Late Gopalakrishnan, in accordance with the Succession Certificate issued in S.O.P.No.109 of 2023 dated 11.12.2024 by the II Additional District Judge, Salem within a time frame.

ORDER
This Writ Petition has been filed for the following reliefs:- "directing the 1st respondent to forthwith disburse the death-cumretirement benefits including GPF, DCRG ad all other terminal benefits payable on account of the death of Late Gopalakrishnan, in accordance with the Succession Certificate issued in S.O.P.No.109 of 2023 dated 11.12.2024 by the II Additional District Judge, Salem within a time frame."
2. The petitioner's case is that her husband, namely, Gopalakannan, was initially married to one Tmt. Dhanalakshmi, through whom respondents 2 and 3 herein were born. After her demise on 06.08.2006, the said Gopalakannan married the petitioner on 13.06.2008, and out of the wedlock, they have two
minor children. On 09.03.2021, her husband passed away due to a massive heart attack while in service.
3. On 02.05.2021, the petitioner had submitted an application before the e 1st respondent seeking settlement of terminal benefits on account of the death of her husband, Gopalakrishnan. However, the 1st respondent insisted on a Succession Certificate citing rival claims. Thereafter, as per the directions of the Tahsildar, Vazhapadi, and the Revenue Divisional Officer, Salem, the petitioner had filed S.O.P. No. 109 of 2023 under Section 372 of the Indian Succession Act on the file of the II Additional District Judge, Salem, and by judgment dated 11.12.2024, a Succession Certificate was granted in her favour.
4. The petitioner's main grievance is that despite submitting representations dated 01.05.2025 and 25.08.2025 along with the Succession Certificate, the 1st Respondent has not disbursed the terminal benefits. Hence, the present Writ Petition.
5. Heard the learned counsel for the petitioner and the learned AGP appearing on behalf of the 1st respondent and perused the records.
6. In view of the order passed in S.O.P. No. 109 of 2023 dated 11.12.2024 issuing a Succession Certificate in favour of the petitioner, this Writ Petition is allowed. The 1st respondent is directed to positively comply with the order passed in S.O.P. No. 109 of 2023 dated 11.12.2024 and disburse the eligible amount due to the petitioner within a period of two months from the date of receipt of a copy of this order. No costs.
