Respondents PRAYER: The Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the third respondent herein to repay the interest amount collected during the moratorium period for a sum of Rs.1.25 Lakhs together with interest at the rate of 18% penal interest.

When the matter was posted for hearing on 04.01.2022, none appeared for the petitioner. Again on 10.01.2022, when the matter was called, there was no representation on behalf of the petitioner and hence, the case was directed to be posted on 24.01.2022 under the caption "for dismissal". Again on 24.01.2022, none appeared for the petitioner. Thereafter, on 07.02.2022, when the matter was taken up for hearing, there was no representation for the petitioner and the case was directed to be posted on 09.02.2022. Even on that day, there was no representation for the petitioner and hence, the Registry was directed to list the matter on 14.02.2022 under the caption "for dismissal". Accordingly, the matter is listed today under the same caption. Even today, when the matter is taken up, none appears for the petitioner. Therefore, the Writ Petition is dismissed for default.
