Apprehending arrest at the hands of the respondent police for an alleged offences punishable under Sections 6(4) TNSC (RDCS) Order 1982 r/w.7(1)(a)(ii) of Essential Commodities Act, 1955 in Crime No.85 of 2016 on the file of the respondent police, the petitioner has come forward with this petition seeking anticipatory bail.
2. The petitioner is arrayed as A4 in this case. The case of the prosecution is that the petitioner along with other accused was found in illegal transportation of 1000 kgs of of PDS rice.
3. The learned counsel for the petitioner submitted that as the petitioner has preferred a complaint against the Inspector of the respondent police station before the Vigilance and Anti corruption Wing, the respondent police is foisting false cases against the petitioner and his family members and he has not committed any such offence.
4. The learned Government Advocate (Crl. Side) opposed for grant of anticipatory bail to the petitioner on ground that huge quantity of PDS rice is involved in this case and if anticipatory bail is granted to the petitioner he will indulge in illegal transportation of PDS rice.
5. Considering the facts and circumstances of the case and taking note of the huge quantity of PDS rice involved in this case, I am not inclined to grant anticipatory bail to the petitioner and the petition is dismissed. 05.07.2016 vrc
