Application No.2730 of 2017 in O.P.No.411 of 2012 K.KALYANASUNDARAM, J This application is filed to condone the delay of 432 days in filing the application to restore the O.P. No.411 of 2012 which was dismissed for default on 07.01.2016.

2. Heard the learned counsel for the applicant and the learned counsel for the respondent and perused the records.

3. The learned counsel for the respondent has no serious objection. The learned counsel for the applicant would submit that he is ready to donate Rs.10,000/- for removal of Karuvelam trees (Juli Flora).

4. Considering the above submissions and being satisfied with the averments contained in the affidavit, delay of 432 days is condoned. The petitioner shall pay a sum of Rs.10,000/- (Rupees Ten Thousand only) in Account No.6514082295, IFSC Code No.IDIIB000H040, Indian Bank, Registrar (Administration), Madurai Bench of Madras High Court, for removal of Karuvelam tree, on or before 15.05.2017.
