Respondent - - - - - - The learned counsel for the defendant submits that the defendant died subsequent to the filing of A. No.1423 of 2024, which has been filed seeking to condone the delay of 53 days in filing the written statement. Since the defendant is dead, A. No.1423 of 2024 has now become infructuous as a fresh application will have to be filed by the Legal Representatives of the deceased defendant. Accordingly, A. No.1423 of 2024 is dismissed as infructuous. However, liberty is granted to the Legal Representatives of the deceased defendant to file an appropriate application seeking to condone the delay of 53 days in filing the written statement. Post the matter on 28.03.2024.
