For the sake of convenience, the parties will be referred to as complainant and accused.
2.The complainant initiated a prosecution in C.C.No.71 of 2006 under Section 138 of the Negotiable Instruments Act against the accused, in which the learned Judicial Magistrate - II, Coimbatore, acquitted the accused on 06.12.2010, challenging which the complainant has filed the present Revision against the order of acquittal with special leave petition. 3.Notice has been served on the accused. Heard the learned counsel for the complainant.
4.However, in the light of a Full Bench judgment of this Court in S.Ganapathy vs N. Senthilvel [(2016) 3 MLJ (Crl) 641 (FB)], the Registry is directed to send the records relating to this case to the Court of the Principal District Judge, Coimbatore, after taking a photocopy of the records on or before 26.02.2018.. The Court concerned after receipt of the revision papers, is directed to issue notice to the parties. Thereafter, the learned Judge is directed to dispose the revision petition https://hcservices.ecourts.gov.in/hcservices/
expeditiously within a period of four months from the date of receipt of the records.
5.The complainant is directed to appear before the learned Principal District Judge, Coimbatore on 12.03.2018 at 10.30 a.m. 6.With the above directions, the Criminal Revision is disposed of.
