ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 406, 420 and 506(1) of IPC in Crime No.2 of 2022 on the file of the respondent police, seek anticipatory bail.

2.The petitioners herein apprehending arrest on the complaint given by one Thiruvengadam alleging that the petitioners under the guise of settling family dispute between the two family, cheated a sum of Rs.25,00,000/- .

3.The learned Government Advocate (Crl. Side) submits that the petitioners under the guise of settling the dispute between the two families has received money from both the family, but, they have neither settled the dispute and nor repaid the money, he received and under the protest of paying to the other party. https://hcservices.ecourts.gov.in/hcservices/

4. The learned counsel for the petitioners submits that the petitioners are ready to settle the dispute and he has already returned Rs.2,00,000/-.

5. This Court is not concerned with an intention of the petitioner herein to return the money, but, it is a clear case of cheating at the inception of receiving money from the defacto complainant itself. The petitioner decided to deceive them and the same is properly seen from the complaint and the material collected by the Investigating Officer. Hence, this Criminal Original petition is dismissed.
