Prayer: Writ Petition filed under Article 226 of Constitution of India praying for issuance of a Writ of Mandamus directing the 1st respondent to remove the illegal cattle farm being run by the respondents 11 to 13 at Plot Nos. 14 and 15, Daga Nagar, Ayappakkam, Chennai 600 077 comprised in Survey No. 324, Ayappakkam Village, Ambattur Taluk, Villivakkam Panchayat union, Thiruvallur District by considering the representation of the petitioner dated 19.12.2025 within a time frame.

ORDER

The main Writ Petition itself is taken up for final disposal at the admission stage. Since no adverse orders are passed as against the respondents 1, 3 to 7 and 10 to 13, notice to the said respondents are dispensed with.

2. This Writ Petition has been filed to direct the 1st respondent to remove the illegal cattle farm being run by the respondents 11 to 13 at Plot No. 14 and 15, Daga Nagar, Ayappakkam, Chennai 600 077 comprised in Survey no 324, Ayappakkam Village, Ambattur Taluk, Villivakkam Panchayat union,

Thiruvallur District by considering the representation of the petitioner dated 19.12.2025.

According to the petitioner, the petitioner - Association is a registered Society bearing registration no.167/2021 represented by its Secretary, situated in S.No.324, Ayapakkam Village, Ambattur Taluk, Villivakkam Panchayat Union, Thiruvallur District within the Chennai Metropolitan Planning Area, classified as Primary Residential Use Zone and approved vide CMDA Approval No.PPD/LO No.12/2013, however, the respondents 11 to 13, who own the residential plots in the said layout, have unlawfully converted the residential premises into the large area of cattle farm and objecting the same, the petitioner made a representation, however, no order has been passed, hence the present Writ Petition is filed.

4. The learned counsel appearing for the petitioner would submit that the cattle farm is an agricultural activity and the same is prohibited in the residential zone, even then, respondents 11 to 13 are running a cattle farm.

5. Per contra, the learned counsel appearing for the 2nd respondent, the learned Additional Government Pleader appearing for the respondents 8 and 9 and the learned Government Advocate (Crl.Side) appearing for the 10th

respondent would submit that unless the local Municipal Authorities or the Authorities of State Pollution Control Board are prohibiting the cattle farm, agricultural activity, there is no prohibition of the said activity in the residential zone. Hence the representation made by the Writ Petitioner cannot be considered.

On going through the entire documents placed on record, it is seen that petitioner - Association is a registered Society, situated in S.No.324, Ayapakkam Village, Ambattur Taluk, Villivakkam Panchayat Union, Thiruvallur District, i.e., within the Chennai Metropolitan Planning Area, classified as Primary Residential Use Zone and approved vide CMDA Approval No.PPD/LO No.12/2013. The grievance of the petitioner is that the respondents 11 to 13, who own the residential plots in the layout, have unlawfully converted the residential area into the large area of cattle farm and objecting the same, the petitioner made a representation.

On the other hand, the contention of the learned counsel appearing for the 2nd respondent and the learned Additional Government Pleader appearing for the respondents 8 and 9 and the learned Government Advocate (Crl.Side) appearing for the 10th respondent is that, unless the local Municipal Authorities or the authorities of State Pollution Control Board are prohibiting the said activity, there is no prohibition for running the cattle farm in the residential zone.

Considering the above said facts and circumstances of the case and taking note of the submission made by the learned counsel appearing for the 2nd respondent, the learned Additional Government Pleader appearing for the respondents 8 and 9 and the learned Government Advocate (Crl.Side) for 10th respondent that there is no prohibition for running a cattle farm and the representation made by the petitioner cannot be considered, the present writ petition seeking a direction to consider the representation, cannot be allowed and the present Writ Petition is dismissed. Consequently, connected miscellaneous petition is closed. No costs.
