JUDGMENT

This criminal appeal has been directed against the conviction and sentence, dated 05.12.2007, passed in Sessions Case No.10 of 2007, by the District and Sessions Court, Salem.

2. The learned counsel appearing for the appellant has contended that as per the judgment passed by the trial Court, the appellant/accused has been sentenced to undergo five years rigorous imprisonment and also imposed a fine of Rs.2000/-, with usual default clause. The accused has paid the fine amount and further he has already undergone the sentence imposed against him.

3. The Superintendent, Central Prison, Coimbatore, has given a certificate, wherein it has been clearly stated that the appellant/accused has already undergone the sentence imposed against him.

4. Considering the aforesaid factual aspects, this criminal appeal has become infructuous and accordingly, the same is liable to be disposed of.

In fine, this criminal appeal is disposed of on the basis of observation made earlier.
