Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents to consider the petitioners' representation dated 04.02.2026 and accordingly, initiate proper acquisition proceedings in accordance with law and pay lawful compensation by adopting due process of law before taking over any portion of the petitioners' lands in Survey Nos.28/7, 28/3A1B1 and 28/6A Kayalarmedu Village, Chinna Obulapuram Mathura, Gummidipoondi Taluk, Thiruvallur District for widening of existing GummidipoondiMatharpakkam Road (Km.0/0 to 6/2) into a two-lane road or for laying any fresh road or otherwise.

ORDER

W.M.P.No.9747 of 2026 filed seeking permission to the petitioners to join together and file a single writ petition is ordered on payment of separate court fee.

This writ petition has been filed seeking for a direction to the respondents to acquire the lands more fully disclosed in the affidavit filed in support of this writ petition by following due process of law and pay the lawful compensation payable to the petitioners based on the petitioners' representation dated 04.02.2026.

3. According to the petitioners, the lands belonging to the petitioners more fully disclosed in the affidavit filed in support of the writ petition are proposed to be acquired by the respondents for widening of the road. The apprehension of the petitioners is that the respondents may, without following the due procedure established in law, acquire their lands. In such circumstances, the petitioners had given a representation on 04.02.2026 to respondents requesting them to follow the due procedure established under law for acquiring the petitioners' land and for payment of lawful compensation to the petitioners. Since the said representation was not considered, the petitioners have filed this writ petition.

4. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents.

5. Necessarily while acquiring the lands of the petitioners more fully disclosed in the prayer to the writ petition, the respondents will have to follow the due procedure established under law as per the provisions of the relevant land acquisition statute.

Accordingly, this writ petition is disposed of by directing the respondents to strictly adhere to the due procedure established under law as per the provisions of the relevant statute for acquiring the lands belonging to the petitioners more fully disclosed in the affidavit filed in support of the writ petition for the purpose of widening of the road.
