ORDER

This writ petition has been filed seeking for a direction to the respondents to acquire the lands more fully disclosed in the affidavit filed in support of this writ petition by following due process of law and pay the lawful compensation payable to the petitioner based on the petitioner representation dated 05.02.2026.

According to the petitioner, the lands belonging to the petitioner more fully disclosed in the affidavit filed in support of the writ petition are proposed to be acquired by the respondents for widening of the road. The apprehension of the petitioner is that the respondents may, without following

the due procedure established in law, acquire his lands. In such circumstances, the petitioner had given a representation on 05.02.2026 to respondents requesting them to follow the due procedure established under law for acquiring the petitioner land and for payment of lawful compensation to the petitioner. Since the said representation was not considered, the petitioner has filed this writ petition.

Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents. The learned Special Government Pleader on instructions submitted that there is no proposal as on date to acquire the petitioner's land for the purpose of widening the road. The said undertaking given by the respondents through the written instruction dated 23.03.2026 has also been placed before this Court.

4. Necessarily while acquiring the lands of the petitioner more fully disclosed in the prayer to the writ petition, the respondents will have to follow the due procedure established under law as per the provisions of the relevant land acquisition statute.

Accordingly, this writ petition is disposed of by directing the respondents to strictly adhere to the due procedure established under law as per the provisions of the relevant statute for acquiring the lands belonging to the petitioner more fully disclosed in the affidavit filed in support of the writ

petition for the purpose of widening of the road. No costs. Consequently, connected miscellaneous petition is closed.
