This application has been filed to eschew the evidence of PW-1, since it was represented that though PW-1 had filed his proof affidavit and had been cross examined in part, he could not appear on further hearings owing to extreme sickness.

This Court had requested the learned counsel for the plaintiff to secure the presence of PW-1 for continuation of cross examination. Accordingly, PW-1 is present in Court today. Consequently, A.No. 5211 of 2016 does not survive and is dismissed.

PW-1 is directed to appear before the learned Additional Master No.I on 19.12.2016 for continuation of cross examination.
